- Limitations of liability: Subject to applicable law. Including liability for personal injury or non-waivable statutory rights under the Swiss law, under no circumstances shall daviesdesign & wordhopeart or anyone associated with daviesdesign & wordhopeart A) be liable to the user with respect to using the website, its content, social media or any of the materials contained in, accessed through or published and/or produced by wordhopeart or the social media aspects of wordhopeart. This includes without limitation any damages caused by or resulting in a user relying on or being misled in their perception of any information provided through the services of wordhopeart. Or any damages that result from mistakes, omissions, interruptions, delays, errors, viruses, delays in operation or transmission or any failure in performance no matter what the cause. Or B) be liable to the user for any indirect, consequential, punitive or exemplary damages including, without limitation, damages for loss of goodwill, lost profits, any other kind of loss, theft or corruption of user information or the disruption or inability of using the site or anything created by or associated with wordhopeart.
- Warranties: The services and products of wordhopeart are provided ‘as is’ and without any kind of warranty. Wordhopeart does not guarantee that services or products will be secure or available at any specific time or place, nor that they will be free of viruses or other harmful materials or that the products and services provided or purchased will meet your requirements or expectations. You use the services, creations and products of daviesdesign & wordhopeart solely at your own risk. In jurisdictions where limitations on implied warranties are not permitted these limitations may not apply.

Any designs, writings, film material, music or any other content or thing created by wordhopeart or their partners and distributed through the website, social media or in any other way, will remain the intellectual property of the designer and may not be used in any other form without the prior written consent of wordhopeart or the designer / writer / producer or publisher the creation originates from. Wordhopeart does allow certain materials to be copied and distributed for free by churches, Sunday schools and other evangelical or missionary groups aiming to use the material to help, encourage and empower others in some way. This use must also be requested by the customer and consented in writing by daviesdesign & wordhopeart. - Pricing and payment terms: The prices and delivery costs displayed through the online stores or other forms of distribution are liable to change at any time but do not affect orders which have already been placed. Prices do not include the Swiss MwSt (VAT) since daviesdesign & wordhopeart is a startup organization (2020) and does not yet reach the limits needed to be subject to MwSt payments. In the event that this limit will be reached in the following years the MwSt will be displayed with the total at the checkout together with the packaging and delivery costs.
Payment for all orders must be made by credit card or through PayPal on the checkout page. We accept payment from most major cards. Please note that online payment transactions are subject to validation checks by your card issuer and we are not responsible for payments which are declined. It is possible that our payments provider will carry out a standard pre-authorization check and that your credit card issuer could charge you with an online handling fee or processing fee, we are not responsible for this.
Shipping: Goods will be shipped as soon as they are available. If for some reason the production process is delayed this may also affect the delivery date, in which case wordhopeart will use any resources available to enable a swift delivery of the ordered product.
Returns: If for some reason your ordered product does not suit your needs and you do not wish to exchange it, please pass it on to someone else who would benefit from it. You may contact us and explain how you were able to bless someone in this way and we will consider issuing you a refund (excluding packaging and postage).
Please only return goods that you have received in a damaged state.
Exchanges and cancellations: If you would like to exchange your order for another size / color or print design you may do so, as long as the product is returned in good shape and within 28 days of purchase (postage stamp date applies). - Product information: merchandise sold through the wordhopeart online marketplaces or by wordhopeart through any other stores or sale techniques is available while supplies last. Sales offered in one marketplace may not apply to another. The prices are originally displayed in Swiss Francs and possibly but not necessarily converted by common currency converters.
- Dispute resolution: You agree that all matters, including disputes resulting from your use of this site or any daviesdesign & wordhopeart products, services or productions will be governed by Swiss law applicable to Kt. Zürich and Winterthur. Any claims under these Terms of Use must be made within one year of the cause. No recovery may be sought or received for damages other than the price paid for the service or product. Any dispute exceeding 30 days should be resolved through mediation. If this does not bring forth a solution, then the parties can pursue any right or remedy available under the applicable law.
